Terms of Service
These Terms of Service ("Terms") form a legal agreement between you and Ecuabet developed by Neptune Mobiware ("we," "us," or "our") and govern your access to and use of the Ecuabet mobile application (the "App"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial purposes.
3. Restrictions
You agree that you will not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App in any way that violates applicable laws or regulations
- Use the App to transmit any malicious code, viruses, or harmful content
- Interfere with or disrupt the integrity or performance of the App
- Attempt to gain unauthorized access to the App or its related systems
4. User-Generated Content
The App allows you to capture and attach your own photos to recipes. Any such content is stored locally on your device. You retain all rights to your content. You are solely responsible for ensuring that your content does not infringe the rights of any third party.
5. Intellectual Property
The App, including all of its content, features, software, design, recipe text, illustrations, and trademarks, is owned by Ecuabet developed by Neptune Mobiware or its licensors and is protected by copyright, trademark, and other intellectual property laws. Recipes provided in the App are educational reference material and are intended for personal, home use.
6. Recipes & Food Safety Disclaimer
Recipes and tips provided in the App are for general informational and culinary-inspiration purposes only. We make no warranty regarding the accuracy, completeness, or suitability of any recipe for any particular purpose. You are solely responsible for ensuring that ingredients are safe for you and your guests, including with respect to allergies, dietary restrictions, and proper food handling. We are not liable for any adverse outcomes resulting from your preparation or consumption of any dish.
7. Updates & Changes to the App
We may, from time to time, release updates, modifications, or new versions of the App. Some updates may be required to continue using the App. We may also discontinue, suspend, or modify any feature of the App at our sole discretion without prior notice.
8. Third-Party Services
The App may use or interact with third-party services (such as analytics or push-notification providers). Your use of such services is subject to the respective providers' terms and privacy policies. We are not responsible for the practices of any third party.
9. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Ecuabet developed by Neptune Mobiware, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, including but not limited to loss of data, loss of goodwill, or any damages resulting from reliance on any recipe or content provided by the App.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ecuabet developed by Neptune Mobiware and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App will immediately cease. You may stop using the App at any time by uninstalling it from your device.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
